According to the Tribunal's Statute, sentences imposed by the ICTY will be served in states "which have indicated to the Security Council their willingness to accept convicted persons." The Agreement establishes both the legal framework within which the sentence will be served and the practical arrangements necessary for carrying out the sentence.
To date, only Drazen Erdemovic, who has been sentenced to five-years imprisonment for participation in mass killings of Muslim civilians after the fall of Srebrenica, is awaiting a transfer from the Detention Unit to a prison of a third country.
