In a decision published on April 12, judges ruled that Kovacevic was not in a position to enter a plea on the charges against him due to mental health problems. Details of his condition were kept confidential.

Kovacevic, who prosecutors say was responsible for crimes including murder and wilful damage to religious buildings and historic monuments in Dubrovnik, was transferred to The Hague in October 2003. He was granted provisional release in June the following year to receive medical treatment in Serbia and Montenegro.

The judges said criminal proceedings against Kovacevic could be reinstated if he is later judged fit to stand trial.
